Ecoflix Foundation is committed to providing a donor-advised fund program of the highest caliber and that fully complies with all legal requirements related to donor-advised funds and sponsoring organizations. As part of its programs, Ecoflix Foundation encourages donor-advisors to support 501(c)(3) charitable organizations that are meaningful and important to them. In order to ensure that donor contributions are deductible to the maximum extent permitted by law, Ecoflix Foundation has adopted the following policies and procedures with regard to the distributions made from its donor-advised funds.
Donor-advisors have the right to make recommendations to Ecoflix Foundation concerning grant disbursements. Consistent with federal tax law requirements, we may accept or reject the recommendations of the donor in our sole and absolute discretion.
Donor-advisors may recommend grants through Ecoflix Foundation’s website at the time they make a contribution to Ecoflix Foundation. Only qualified public charities that meet Ecoflix Foundation’s strict requirements and that have been pre-approved by Ecoflix Foundation may receive grants from Ecoflix Foundation’s donor-advised funds. Qualified charities generally include those described in the Internal Revenue Code sections 509(a)(1) or 170(b)(1)(A) (other than Type III nonfunctionally integrated supporting organizations) as listed in the Business Master File or the IRS’s Tax-Exempt Organization Search website. The pre-approval process will include review by Ecoflix Foundation’s board of directors of an organization’s credentials including, among others, its exempt purposes, values, financial history, director and staff qualifications.
Ecoflix Foundation performs due diligence on each organization recommended for support using publicly available information including IRS records and publicly disclosable documents. If we cannot verify that an organization satisfies our and IRS requirements, or we have other concerns based upon our due diligence, we will refuse to make a recommended grant. If we refuse to make a recommended grant, we will notify the donor-advisor that the recommended grant cannot be awarded.
Ecoflix Foundation will not make grants to private foundations, Type III nonfunctionally integrated supporting organizations, or other donor-advised fund sponsor organizations.
Ecoflix Foundation will not make grants that provide anything more than an indirect or incidental benefit to the donor, donor-advisor, their family members or other related persons, including a grant that would fulfill a legally binding personal pledge of any such person.
Ecoflix Foundation will not make any payments or distributions of any kind, whether a grant, loan, compensation or expense reimbursement or other payment, to any donor, donor-advisor, a member of the donor or donor-advisor’s family, or a 35% controlled entity of such person.
Ecoflix Foundation will not make any excess benefit transactions from donor-advised funds to donors, donor-advisors, or related persons, and it will not make any excess benefit transactions to investment advisors or related persons.
